Am I required to register for the FMCSA clearinghouse?DOT Companies: Federal Motor Carrier Safety Administration (FMCSA) drug & alcohol program is required by law to register with the FMCSA Drug and Alcohol Clearinghouse (DACH). Employers who do not comply with the FMCSA requirements are subject to the civil and/or criminal penalties set forth at 49 U.S.C. 521(b)(2)(C) (i.e., civil penalties not to exceed $2,500 for each offense). nonDOT: NO Employers must register themselves and their drivers in the Clearinghouse, they cannot outsource this function to a C/TPA – Consortium/Third Party Administrator. Have your drivers go to https://clearinghouse.fmcsa.dot.gov/ to register and give consent for you to access their information. Owner Operators: MUST designate a C/TPA – Consortium/Third Party Administrator for reporting owner operator violations. The owner operator can also ask the C/TPA to perform other required tasks on their behalf in the Clearinghouse. Drivers: If you hold a Commercial Driver’s License (CDL), or similar license issued by Mexico or Canada, and operate a Commercial Motor Vehicle (CMV) in any state. Commercial vehicle is described as: - with a gross vehicle weight rating/gross vehicle weight or gross combination weight rating/gross combination weight of 26,001 or more lbs., or - designed to carry 16 or more passengers (including the driver), or - of any size that is used to transport hazardous materials which require the vehicle to be placarded

What happens if I leave the testing site?DOT: Fail to remain at the testing site until the testing process is complete; is considered a refusal to test. nonDOT: Your Designated Employer Rep would be notified immediately.

What happens if I receive a positive drug and/or alcohol screening?DOT: Drivers will be reported to the clearinghouse and will be required to register into a Substance Abuse Program. The SAP Professional (SAP) will help the driver with the return to duty process. Drivers that want to view any information on them in the Clearinghouse must be registered. nonDOT: Your Designated Employer Rep would be notified immediately.

What happens if I refuse to be tested?If you refuse a DOT drug test, the employer is required by DOT regulations to enter that as a violation into the FMCSA Clearinghouse. This violation would prompt you to have to complete the RTD process to return to safety-sensitive work. nonDOT: Your Designated Employer Rep would be notified immediately. Please note there is a NO REFUND POLICY for all services offered.
